SMS Terms
These SMS Terms and Conditions govern the Cactus Jack’s Hiring and Employee Text-Messaging Program operated by Cactus Jacks Bar & Grill Corp., doing business as Cactus Jack’s.
1. Program Name
Cactus Jack’s Hiring and Employee Text-Messaging Program.
2. Program Description
Cactus Jack’s sends transactional and conversational text messages to job applicants and employees who voluntarily consent. Messages may include application confirmations, interview scheduling links, confirmations and reminders, rescheduling or cancellation notices, hiring-status updates, employee portal invitations and access notices, training assignments and reminders, document notifications, TABC and Food Handler certificate reminders, certification-expiration notices, policy acknowledgments, electronic-signature verification codes, employee document notifications, and responses to questions. This program is not intended for unrelated advertising or third-party marketing.
3. Consent to Receive Messages
By providing your mobile telephone number and voluntarily selecting the separate SMS-consent checkbox on a Cactus Jack’s application or employee portal, you agree to receive recurring transactional and conversational text messages. The checkbox is separate from other agreements and is unchecked by default. Consent is not a condition of submitting an application, scheduling or attending an interview, receiving an offer, being hired, maintaining employment, or accessing required information through another available method. You may opt back in by texting START, YES, or UNSTOP.
4. Message Frequency
Message frequency varies based on your application, interview schedule, employment status, training assignments, certification requirements, requested verification codes, and interactions with Cactus Jack’s. You may receive multiple messages during an active application, interview, onboarding, training, certification, or document-verification process.
5. Message and Data Rates
Message and data rates may apply according to your mobile telephone plan. Cactus Jack’s does not charge a separate fee for participating.
6. Opting Out
You may stop messages at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT. After opting out, you will receive a final confirmation and no additional program messages unless you opt in again. You may opt back in by texting START, YES, or UNSTOP, or by completing the original opt-in process. Opting out does not prevent contact through another lawful method when necessary.

8. Supported Carriers
Participating mobile carriers may vary. Your carrier is not responsible for message content. Carriers are not liable for delayed or undelivered messages, and delivery is subject to network availability and cannot be guaranteed.
9. Mobile Number Responsibilities
By enrolling, you confirm that you are the subscriber or authorized user of the number provided, that the number is accurate, and that you will notify Cactus Jack’s or opt out if ownership or authorization changes. Do not permit another person to use a verification code intended to confirm your identity or signature. If your number changes, opt out from the previous number and complete consent using the new number.
10. Verification Codes and Electronic Signatures
Cactus Jack’s may send one-time verification codes to confirm portal access, document acknowledgment, or electronic signatures. Codes are intended only for the person associated with the receiving number. Do not share a code with a manager, coworker, applicant, employee, or other person except when personally entering it into an authorized Cactus Jack’s verification screen. Cactus Jack’s will never ask for a password through an unsolicited text message.
11. Employment Disclaimer
Participation does not guarantee an interview, employment offer, or continued employment; create an employment contract; change at-will employment status when applicable; or replace official policies, notices, or employment records. Text messages are a communication convenience. Applicants and employees remain responsible for reviewing official information through the appropriate application, portal, manager, or company representative.
12. Privacy
Information is handled according to our Privacy Policy. Mobile telephone numbers, SMS opt-in information, and consent records will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
13. Program Changes or Termination
Cactus Jack’s may change, suspend, or discontinue the program or its features when reasonably necessary. We may revise these terms by posting an updated version. Continued participation is subject to the revised terms and any legally required consent.
14. Governing Law
These terms are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles.
